YOUR SOLE REMEDY FOR ANY BREACH OR DEFAULT OF THIS AGREEMENT BY NEVA MASQUERADE LLC OR WEBSITE OWNER SHALL BE A RETURN OF ANY FEES PAID TO NEVA MASQUERADE LLC DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENTS GIVING RISE TO THE CLAIM OR $100, WHICHEVER IS GREATER.

5. INDEMNIFICATION.

You indemnify and agree to defend and hold harmless Neva Masquerade LLC, Website Owner, its and their officers, employees, agents, affiliates, licensees and web hosting services and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards or settlements) relating to or arising out of your use of https://nevamasquerade.design/, including any breach by you of the Terms contained in this Agreement.

6. ERRORS AND OMISSIONS.

All information on this website is accurate and true to the best of Neva Masquerade LLC’s knowledge, but that there may be omissions, errors or mistakes. Neva Masquerade LLC is not liable for any damages due to any errors or omissions on the website, delay or denial of any products, failure of performance of any kind, interruption in the operation and your use of the website, website attacks including computer virus, hacking of information, and any other system failures or misuse of information or products.

11. REFUND POLICY.

If you are unsatisfied for any reason, Neva Masquerade LLC will issue a refund within 7 days after purchasing. After 7 days, Neva Masquerade LLC will no longer issue you a refund.

14. JURISDICTION.

These Terms and Conditions are governed by and construed in accordance with United States federal law and the laws of the State of Virginia. Any dispute arising out of or related to the information contained herein is subject to adjudication in the state of Virginia, USA.

15. DISPUTE RESOLUTION.

Before filing any claim or initiating arbitration, you agree to first contact Neva Masquerade LLC at contact@nevamasquerade.design to attempt to resolve the dispute informally.

If the dispute cannot be resolved within 30 days, any claim or controversy (except for claims eligible for small-claims court) shall be settled by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration may be conducted by telephone, video conference, or based solely on written submissions, and will take place in Alexandria, Virginia, unless otherwise required by law. The arbitrator’s decision shall be final and binding, and judgment on that award may be entered in any court of competent jurisdiction.

Either party may bring an individual action in the small-claims court located in the State of Virginia, provided that the claim falls within that court’s monetary and subject-matter jurisdiction.

All claims must be brought on an individual basis and not as part of any class, consolidated, or representative action.

16. WAIVER.

The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner.

17. SEVERABILITY.

If any provision is found to be invalid, the remaining provisions will be in full force and effect.
